In 2011 an independent review of Law Mutual (WA) was completed taking into account environmental forces, particularly the impact of potential national legislative changes. The review concluded that the existing arrangements (the Scheme) was compliant with the requirements of the Legal Profession Act 2008 and the Legal Profession Regulations 2009 and that there did not appear to be any cogent reason to vary the Scheme in the then current environment.
The Law Society’s 2020-2023 Strategic Plan states that a further strategic review of Law Mutual (WA) will be undertaken in 2021/2022 as per below:
Undertake a strategic review of Law Mutual (WA) taking into account environmental forces, particularly the impact of legislative changes nationally and the statutory obligations of the Law Society and Law Mutual (WA) and the methodologies available to discharge those obligations.
The 2021/2022 review will consider the 2011 review report and whether:
• The operations of Law Mutual (WA) still adequately undertake part or all the functions required by the statutory obligations;
• There are any alternative methodologies, other arrangements or schemes that operate in similar jurisdictions (e.g., NSW, Victoria, Qld, SA and UK), and their relative success or failure, which could better undertake part or all of those functions.
Responses to a Request for Proposals (RFP) to undertake the 2021/2022 review of the functions of the Law Society of WA (Inc) that are contained in Part 11 of the Legal Profession Act 2008 and Part 9 of the Legal Profession Regulations 2009 are being invited from suitably qualified consultants/firms. Responses close on Friday 17th September at 3:00pm WST.
