In August 2022, Cabinet agreed to establish an Artist Resale Royalty scheme (the scheme) in Aotearoa New Zealand (NZ). The scheme will provide visual artists (or their estates) with a five percent royalty when their eligible work is resold on the secondary art market in NZ and other reciprocating countries. The collection and distribution of these royalties will be administered by a collection agency.
We are looking to appoint a non-profit, non-government organisation (NGO) as a collection agency to administer the scheme. The NGO must have the appropriate knowledge, skills, experience, capability, and resources to undertake the role and functions as legislated under section 22(3)(a) of the Resale Right for Visual Artists Act 2023 (the Act).
Manatū Taonga is looking to partner with an organisation that has strong networks within the visual arts sector, existing capabilities in the collection and distribution of payments to and from third parties, and a commitment to improving career sustainability for visual artists. We only expect to shortlist organisations that have a proven track record doing similar work.
There are three eligibility pre-conditions that an NGO must meet to be considered for the role of the collection agency. It must:
• have current NZ legal status
• not operate for the purpose of profit-making
• have experience in the collection and distribution of funds from/to third parties.
