Tender Description

As part of its work to support the 2026 Statutory Review, the Department is now seeking expressions of interest from the market to identify alternative compliance arrangements of the NVES Act to explore the viability of changing the point of compliance for the NVES from point of import to point of sale, or another compliance point.

Other Instructions:

This REOI seeks supplier input to help provide initial scoping for a possible change to the point of compliance for the NVES. It seeks supplier input into potential solutions that explore the viability, costs and scope of moving the point of NVES compliance. Respondents are encouraged to identify innovative solutions and consider the following when preparing their responses:

• Identifying the information and data from automotive industry and/or government sources that could support alternative compliance points.

• This should include delivery of an accurate sales register that supports tracking of vehicle deliveries to end users in the Australian market including real time updates – proven experience and engagement with NEVDIS is highly desirable.

• Scoping the impact of a shift of the point of compliance on existing legislation and regulatory frameworks.

• Assessing the shift of point of compliance to other points (eg point of sale) against the objects of the NVES Act.

• Assessing the impact on the Australian automotive industry of each option to change the point of compliance.

• This should include the time that might be required for the industry to make such a change.

• Suggested project timing for moving NVES compliance point to each of the identified alternative points of compliance.

• This work must be completed by mid-June 2025.

Conditions for Participation:

• The Respondent must not have had any judicial decisions against it (excluding decisions under appeal) relating to employee entitlements and have not paid the claim.

• The Respondent, its personnel, and any Subcontractors proposed in the Submission must not, at the Closing Time, be listed as terrorists under section 15 of the Charter of the United Nations Act 1945 (Cth).

• The Respondent (and any Subcontractor proposed in its Submission) must not be named in the Consolidated list referred to in Regulation 40 of the Charter of United Nations (Dealing with Assets) Regulations 2008 (Cth).

Timeframe for Delivery:

The date from which the relevant Respondent(s)’s distribution arrangements will be available will be outlined in a future procurement process (expected to be conducted in Quarter 2 of 2025), which will be informed by submissions to the REOI.
