Tender Description
MAV Procurement, on behalf of MAV Insurance, is undertaking a Public Tender for the provision of Legal Services to the Municipal Association of Victoria in relation to its Liability Mutual Insurance Scheme (LMI).
A panel of law firms will be appointed to provide legal services for litigated claims for the MAV in relation to the LMI Scheme. The panel structure is intended to provide the MAV with access to a specialised range of skills, expertise, and experience in broadly defined areas of law that are commonly the subject of public liability and professional indemnity claims brought against our local government members in Victoria and Tasmania.
To meet the needs of MAV Insurance, this Request for Tender (RFT) specifically seeks responses from Law Firms who specialise in the following:
- public liability litigation and dispute resolution (including personal injury, property damage and products liability matters);
- professional indemnity litigation and dispute resolution;
- general litigation and dispute resolution (including, but not limited to, actions under the Road Management Act 2004, Planning and Environment Act 1987, Planning and Environment (Planning Schemes) Act 1996, and Water Act 1989 in the Victorian Civil and Administrative Tribunal, and inquests and inquiries in the Coroners Court), and Civil Liability Act 2002; and
- commercial and administrative advice to the MAV in connection with its management of the LMI Scheme.
For example, but not limited to:
- administrative law (government and public law and law relating to public administration, including policy review and drafting);
- financial services law; and
- general commercial law (law affecting the government as a participant in commercial transactions, particularly trusts law, taxation law and general insurance law).
It is necessary for Respondents to be able to demonstrate expertise in all of these areas.
The contract period is for an initial five (5) year term with two (2) two (2) year extensions at the discretion of the MAV.
